Hire Terms & Conditions

Payment and Security Deposit

The hire charges will be required in full before the bikes are made available for hire. Payments must be made using a debit or credit card. e-Xplore Devon Ltd will copy and hold your credit or debit card details for the duration of the hire agreement and will destroy this information on return of the equipment in a satisfactory condition.

e-Xplore Devon will also require photo i-d in the form of a driving licence or passport which may be copied and a photograph of the lead hirer and hire equipment will be taken at delivery of the e-bikes. Upon acceptance of the hire agreement you agree to these security measures taking place.

Upon acceptance of the hire agreement you further understand that you will be liable for any damage, theft or loss to bikes and any accessories you have hired from e-Xplore Devon Ltd and that any repairs required or replacements will be made at the full recommended retail price. In the event of damage, theft or loss payment will be taken from the card supplied up to a maximum amount of £900 and full receipts and invoices will be made available to support these charges.

The person signing the hire agreement is responsible for all the equipment supplied by e-Xplore Devon and accepts financial liability for all members of a party using the equipment.

Late returns of equipment will be charged at the full daily hire rate. There will be no refunds for early return of bikes or accessories under any circumstances.

Cancellations will be subject to the following charges;

  • Over 2 weeks prior to the hire date – No charge
  • Up to 2 weeks prior to the hire date – 10% of total booking
  • Up to 1 week prior to the hire date – 20% of total booking
  • Up to 3 days prior to the hire date – 50% of total booking
  • 1 day prior to the hire date – 75% of total booking
  • Day of hire will be charged at full hire rate of the booking

Cancellations due to extraordinary circumstances will be considered for each individual booking. Where a booking is re-scheduled within the cancellation period no further refund will be offered if the new booking is subsequently cancelled. However, a credit note may be issued subject to circumstances and conditions.

General Safety and Security

Upon signing the hire agreement you accept responsibility for anyone using a bike supplied by e-xplore Devon and confirm that you are satisfied with the condition of the items supplied and that they are fit for purpose. If you do notice any issues or problems with the equipment it must be raised before hire takes place where a replacement will then be supplied.

You and your party understand and agree that cycling is an activity that carries a certain degree of risk and accept that anyone using bikes and equipment supplied by e-Xplore Devon Ltd do so at entirely at their own risk.

e-Xplore Devon will not be held responsible for any mechanical failure due to any customer adjustments made to the e-bikes. Additionally, e-Xplore Devon Ltd can not be held responsible for accidents, injury or death relating to third parties or members of the hire party during the hire period.

We strongly suggest you check your home insurance policy for personal injury cover and make arrangements if not already covered. We also recommend joining Cycling UK where, amongst the many benefits, you will receive 3rd party liability cover.

It is against the law to use an e-bike below the age of 14 and you confirm that all e-bike riders in your party are above this age.
We will supply, with each bike hired, a helmet and a high visibility vest that should be worn at all times using the e-bikes. e-Xplore Devon Ltd can not be held responsible for any accident, injury or death that occurs as a result of not wearing helmets or other safety equipment supplied.

Most of our e-bikes have sensitive, hydraulic disc brakes and extreme care must be taken applying pressure, particularly to the front brake. Please always use both brakes together at the same time.

It is the responsibility of each user to ride responsibly and in a safe manner observing all the rules of the roads. Racing of the e-bikes is forbidden and users should bear in mind their level of competence before tackling demanding terrain.

Each bike is supplied with a lock which must be used to secure the bike to an immovable object whenever it is left unattended. These periods should be kept to a minimum and where possible the battery should also be removed and taken with the rider.

Additionally, top boxes should be locked to protect any items stored inside. However, e-Xplore Devon Ltd accepts no liability for the loss, damage or theft of any personal items stored in or on the bikes. If a theft or loss occurs or any damage is done to the bikes it is your responsibility to inform a member of the e-Xplore Devon Ltd team immediately and you further acknowledge that you are also liable for all costs incurred including reasonable loss of hire and these costs can be recovered from your credit or debit card.

When the bikes and any accessories are in your possession you are responsible for keeping these items safe and using them in a manner that is fit for purpose.

Personal Safety and behaviour

Riding the hire bikes under the influence of alcohol, drugs and/or solvents is not permitted and will result in the immediate cancellation of the hire agreement and the return of bikes and accessories with no refund or any other obligation or further liability to you.

Insurance

We advise that you do not ride without personal and third party liability insurance.

We strongly suggest you check your home insurance policy for personal injury cover and make arrangements if not already covered. We also recommend joining Cycling UK where, amongst the many benefits, you will receive 3rd party liability cover.

Cycling Expectations

It is your responsibility to ensure that anyone using our e-bikes and accessories does so sensibly and applies respect to other cyclists, road users and the natural surrounding area.

You must follow the rules for cyclists as laid out in The Highway Code and you must not use the bikes on excessively rough and rutted un-metalled roads or on the beach.

Use on beaches and bike returns

Sand and salt-water are particularly damaging to bike components and riding on sand or heavily sand-covered areas is strictly forbidden. Evidence of use on sand will result in charges being made for deep cleaning. Whilst we appreciate hire bikes will get dirty, particularly when wet and muddy, any bikes returned excessively soiled may also be subject to additional cleaning fees charged at our hourly service rate.

Individual Health

Upon accepting this hire agreement you are confirming that all members of your party are in good health and no one has eyesight that is below the minimum standard required for a road driving test. You also confirm that all members of your party are free from any medical condition or disability that may adversely affect the usual control of the bike.

E-XPLORE DEVON LTD RESERVES THE RIGHT TO NOT ACCEPT OR FULFIL A BOOKING AND ALL BOOKINGS ARE SUBJECT TO AVAILABILITY.

These terms and conditions are governed by English Law.
